1. About These Terms

These Terms of Service ("Terms") govern your use of transformwithtoska.com and all services offered by Transform with Toska, operated by Toska Rose trading as Transform with Toska, a VAT-registered business based in the United Kingdom ("we", "us", "our").

By purchasing a product or service, joining the Many Butterflies community, or using our website, you agree to these Terms. Please read them carefully. These Terms are governed by the laws of England and Wales.

2. Our Services

  • Live workshops delivered online (including I Choose Me and future workshops)
  • Online programmes and courses delivered over a fixed period
  • Many Butterflies: a paid community membership hosted on Telegram
  • A free newsletter

3. Purchasing Services

3.1 Workshops and Programmes

When you purchase a workshop or programme, you are purchasing access to a specific scheduled event or course. Prices are shown on the relevant product page. All prices are in GBP or USD as displayed. UK customers will be charged applicable VAT.

3.2 Community Membership

Many Butterflies is a monthly subscription. Your membership begins on the date of your first payment and renews monthly until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.

3.3 Payment

Payments are processed by Stripe (card) or GoCardless (direct debit). By completing a purchase you authorise us to charge the stated amount. For subscriptions, you authorise recurring charges until you cancel.

4. Cancellations and Refunds

4.1 Workshops and Programmes

If you cancel at least 7 days before a scheduled workshop, you are entitled to a full refund. Cancellations within 7 days of the event are not eligible for a refund, but you will retain lifetime access to the replay where one is provided. If we cancel or significantly reschedule an event, you will receive a full refund.

4.2 Community Membership

You may cancel your Many Butterflies membership at any time. We do not offer pro-rata refunds for unused portions of a monthly billing period. On cancellation you retain access until the end of the period you have paid for.

4.3 Statutory Rights

Nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Contracts Regulations 2013.

5. Replays and Recordings

Where we state that a workshop or session includes replay access, we will make a recording available within 5 business days of the live session. We aim to maintain replay access indefinitely but reserve the right to remove recordings with reasonable notice.

6. Community Rules (Many Butterflies)

By joining the Many Butterflies community you agree to:

  • Treat all members with respect and kindness
  • Keep the content of the community confidential
  • Not share, screenshot, or redistribute content from other members without their explicit permission
  • Not use the community for commercial promotion, unsolicited messages, or spam
  • Not post content that is harmful, discriminatory, abusive, or unlawful

We reserve the right to remove any member who violates these rules without refund.

7. Intellectual Property

All content on our website, in our programmes, workshops, and community — including written content, recordings, frameworks, and methodology — is owned by Transform with Toska and protected by copyright. You may not reproduce, distribute, or use our content for commercial purposes without our written permission.

8. Our Content is Not a Substitute for Professional Advice

Transform with Toska offers psychology-informed content for personal development and transformation. Our content is educational in nature and does not constitute therapy, clinical psychology, medical advice, legal advice, or financial advice. If you are experiencing a mental health crisis, please contact a qualified mental health professional or dial 999 in an emergency. The Samaritans can be reached on 116 123.

9. Disclaimer of Warranties

To the fullest extent permitted by law, our services are provided “as is” and “as available” without any warranty, express or implied. We expressly exclude all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that: (a) our services will be uninterrupted, error-free, or free from viruses or other harmful components; (b) any results obtained from use of our services will be accurate, reliable, or meet your requirements; (c) any defects in the services will be corrected. You assume full responsibility for your use of our services and any results thereof.

Nothing in this clause affects any rights you may have as a consumer under UK law that cannot be excluded or limited.

10. Limitation of Liability

To the fullest extent permitted by law, Transform with Toska is not liable for any indirect, consequential, incidental, special, or punitive loss or damage arising from your use of our services, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, whether based in contract, tort, negligence, or otherwise, even if we have been advised of the possibility of such loss.

Our total aggregate liability to you for any claim arising under or in connection with these Terms or your use of our services shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be limited or excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Transform with Toska, Toska Rose, and any employees, contractors, agents, or representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of or access to our services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights, including intellectual property rights or privacy rights
  • Any content or material you submit, post, or transmit through our services or community
  • Any dispute between you and another user or member of our community

We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defences.

12. Force Majeure

Neither party shall be liable for any failure or delay in performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond that party’s reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic, war, terrorism, civil unrest, government action or regulation, power or internet outages, strikes or labour disputes, platform outages or failures of third-party services (including Zoom, Telegram, Stripe, or any other provider we rely on), or any other event of force majeure.

The affected party shall notify the other as soon as reasonably practicable and shall use reasonable endeavours to mitigate the effects of the force majeure event. If a force majeure event prevents us from delivering a workshop or live session for which you have paid, we will offer a rescheduled date or a full refund at your election.

13. Changes to Services and Terms

We may update these Terms from time to time. Material changes will be notified by email with reasonable notice. Continued use of our services after the effective date of any change constitutes acceptance of the updated Terms. We reserve the right to change, suspend, or discontinue any service with reasonable notice; where a paid service is discontinued, we will issue a full refund for unused portions.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and AI and Data Statement, constitute the entire agreement between you and Transform with Toska with respect to your use of our services and supersede all prior agreements, representations, and understandings, whether written or oral.

17. Waiver

No failure or delay by us in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right. A waiver of any breach of these Terms shall not be construed as a waiver of any subsequent breach.
